Bungie, the developer of Destiny 2, has recently been on a legal tear, suing one user for cheating and threatening its employees, as well as a YouTuber who filed nearly 100 false DMCA claims against other creators.

Bungie is now facing a countersuit after suing cheat developer AimJunkies last year. According to TorrentFreak, AimJunkies claims the developer illegally hacked an associate’s computer (via Kotaku). They also claim Bungie violated the DMCA by circumventing the machine’s security.

Bungie’s current Limited Software License Agreement (LSLA) allows the company’s BattleEye software to scan computers for anti-cheat tools, but this wasn’t the case in 2019, when the alleged hack was first discovered.

Bungie accessed a computer owned by its associate James May several times between 2019 and 2021, according to AimJunkie’s counter-suit. It then claims that Bungie used information obtained from the hacks to gather information on other potential suspects.

If this sounds ironic, it’s because Bungie accused the company of using similar tactics in its original suit. James May and Phoenix Digital are seeking monetary damages as well as an end to all future hacks and DMCA violations.
